Here is a how it could work. EXAMPLE: You are subjected to a hostile work enviornment. You are not sure how to defend yourself. You click on our document page and waalaa - how to's, go-by's, statagies, pitfalls, timelines, what to expect, common mistakes, historical agency practices, etc. But, best of all - you find documentation that the person who has subjected you to the hostile work enviornment (or plug in reprisal, sexual harrassment, etc.) has been repeatedly investigated for the same allegations. This person maybe has a judegement against them for the very same type incident you are suffering under. Maybe this person has perjured themselves in the past. Maybe this person has Giglio Material in their file that impeaches their credibility. If you go it alone you might have never known this and had no way to ever find out. If we go it together then we help each other defend ourselves. This is not meant as encouragement to file complaints. It is meant that if you are subjected to REAL abuses, not hurt feelings or a cross word directed your way, but, the real and repeated significant abuses that many in this agency have suffered, this proposed documents page could be the key to the successful resolution of your dispute. For starters: Have you proposed your complaint to your first-line supervisor, or, have you filed an internal grievance, or, did you do so and were told that your complaint is not credible (when you know it is)? This is where the problems start. You just want to have your situation addressed and ATF's skilled leaders (sarcasm) tell you to shut up. ATF's Chief Counsels Office has tried to spin the table on you and defend a bad act by their managers by making a counter allegation agains you? REAL TIME EXAMPLE: An ASAC had over 20 EEOC complaints filed against him for harrassment over many years. Each time ATF's Chief Counsels Office backed the ASAC, never one time questioning that maybe the ASAC was the problem and not the 20 individual agents. The ASAC's confidence grew to where he was bragging on how many EEOC complaints he had filed on him and that thanks to Loos and crew not one of them stuck. He openly stated that he had perjured himself in depositions because he knew there was no consequences if he was caught. Not until he became so overconfident in his abuses and they became so outrageous was he ultimately forced to resign. But, not before Director Sullivan and Ronnie Carter tried to hide him as an Executive Assistant to the Director. Now, this information came out late and all the abused agents in this ASAC's path of destruction never had the opportunity to exchange information. How many of these events would have occured if these agents had been able to communicate and show the court the pattern and practice of this ASAC and ATF's attorneys? Now you will have somewhere to go for help.

I would be willing to share with other Agents copies of eeoc motions, discovery requests, statements, orders etc., On this topic (eeoc) I have heard some advice in the forums. One thing I would recommend is to have a prepared written statement at the stage where you are interviewed by the CONTRACT Investigator. You can incorporate this by reference into any affidavit he takes during a Q & A session. I have seen other statements prepared by Contract Investigators in eeoc cases and even the most experienced Agent can come across as a rambling eejit.. And remember, and I know we know better, the Contract Investigator is not your friend, he is hired by the Agency. The Agency uses DSZ alot. They have a cloudy history (check them out). They rarely ask or get from the Agency the documents you need for investigation to prove your case. You should request them in your statement. Also, watch your timelines. As soon as the Agency misses one - document it to the AJ in writing. If the Agency Investigation is not completed on time (180 days?)always request by motion for the Agency to be sanctioned including judgement in your favor. Keep a timeline. Send all mail certified. Lets get this moving. A tab for the posting of official documents that will assist ALL employees in overcoming the DeathStar's bad practices. Findings of mismanagment, reprisal, perjury, lack of candor, retaliation, hostile work enviornments, unethical attorney practices, settlements, etc., that are linked to individual managers need to be posted. Documents of grievances, EEOC complaints, OIG and OSC referals, IA referals, lawsuits, congressional requests, court findings, etc., that can serve as "go bys" for ALL employees who are being shut out are invaluable. ATF Cheif Counsel has survived using a "divide and concur" approach that have kept us in the blind. This is how we defeat that. Agent X on the east coast has never had the ablility to know that Agent Y on the west coast suffered through an identical situation. So much of this site has addressed communication. We need to communicate with each other to help one another win valid complaints against those who have repeatedly abused us.

I think that is a great idea. CUATF should create a TAB where everyone can download findings,depositions,emails,declarations and OSC/OIG investigations. Stay tuned.

I am all for it and think it would be overwhelmingly helpful to employees in dispute with the agency. It seems like the same managers over and over again commit the same bad acts. The other consistency that that abusive acts are routinely committed by various managers but the agency's attorneys use the same unethcial tactics to defend them. Time to break their toy of lying and cheating to win cases where they know they are wrong. Spread the word!

could we start a "WikiLeaks" type forum, perhaps in camera (administered by moderator) where documents could be posted that expose prior inconsistent statements by management. these documents could be from eeoc, mspb testimony etc. ??
