ATF Sues Agent, Agent Fires Back

Are agents forwarding this stuff to their Senators and Representatives? At the very least, are they notifying the members of the Senate Judiciary committee?


Agents repeatedly have notified their senators and representatives and failed to get any responses. The same goes for ATF IA and DOJ OIG. That may change in the near future, and that lack of focus and response may need to be explained, but it is another example of the fact that ATF seems to be simply a nuisance to its detractors and the politicians that view it only as a necessary evil. Despite the high character of our agents and the quality of work they produce, it is easier to turn a blind eye and give Magaw his square drinking glasses and dust masks for visits to public restrooms, to allow Truscott to play with his soap dispensers and bathroom tile, and to smile and let Sullivan lower the passing score on the TEA exam for ATF agent applicants to 60%. It's nothing short of laughable tragedy.

Jay is dangerous because he does not care what they say about him or do to him. When they threatened him with termination he laughed in their faces. That was an ill-concieved scare tactic. This guy is their worse nightmare because he knows he's right and they do to. He will beat on them as long as they keep this alive. If you know him then you know he will not roll over or be intimidated or quit. They picked a fight with the wrong agent. When they involved his family they took the resolve of a guy who has spent his life overcoming challenges as an underdog. One guy is taking on the entire DOJ machine and everytime they hit him with a spitwad he sets off a nuke in their laps.

ATF and DOJ are going to end up on the wrong side of history on this one. Think about it. You take a guy who has spent 20 years going toe to toe, eye to eye with violent criminals so does anyone really think he is afraid of a bunch of managers or attorneys who are to chickens**t to meet with him face to face?

Is AD Wilfred Ford paying attention? Is anyone at 99 New York Ave.awake? The agency with the support of a DOJ attorney cannot support their own conduct throughout the Dobyns Arson and threat situation. So instead they sue him for damaging the government merely to cause him more grief and expense in hopes he will quit (they obviously are not paying attention). Then they post a glowing article about how well SA Dobyns represents the Bureau at a prestigious Good Friday Breakfast and reference his book. Is their nothing ATF bosses wont take credit for at any expense? Is their NO shame? Damage us some more Agent Dobyns. It some of the only positive press we are getting these days.

ATF, please tell me its not true that you sued Agent Dobyns for his book and then posted a news story promoting his book, with a picture of the cover attached no less, on the ATF website! Seriously, which way to do you want it? You can have it one way or the other but you can't have it both ways. You sue him in federal court behind allegations that he damaged the government with his book and then you post a story like this to the ATF's highlights newsclips. Pull it down and block it like you did cleanupatf but all these people, all your executives, know you did it. Brilliant!

1,000 guests enjoyed the Good Friday breakfast at the Tucson Convention Center.

After a record-setting athletic career as a wide receiver for the University of Arizona Wildcats, Jay traded his football pads for a badge and gun as a Special Agent with America’s violent crime police force – the U.S. Bureau of Alcohol, Tobacco and Firearms (ATF).

Dobyns was the unconventional, full-bore federal agent who achieved worldwide notoriety as one of America’s most daring and talked-about law enforcement officers. After more than twenty years of undercover assignments that targeted the world’s most deadly criminals and their organizations, Dobyns was infamously “outed” following an unprecedented and successful infiltration of the Hell’s Angels outlaw biker gang.

Dobyns’ introduction to the street was immediate, vicious and nearly fatal. Within a week in the field he was taken hostage and shot through the back and chest. Dobyns shared his experiences as a undercover agent within the Hells Angels and how God’s hand was there in some of the toughest situations in his life.

Ford and Torres have been courting Hollywood for years. Both have tried to pitch shows and offer ATF resources up to engratiate themselves to the Industry. Wilfred Ford has spent many years riding on the backs of working Agents. He has signed lies to congress and no one has released more trade secrets than John Torres himself. Is the agency going to counter sue them now? And why would Ford be considered an authority on anything within ATF, he has been in the field for even half of his career. DAD Martin was quite the camera hog back in the day too.



Which Torres? Because there is a Torres that has not missed a Ms. Universe contest....

Hey Lips, you left off the best part. I wanted to post the Dobyns response but you beat me to it.

I went to the Court of Claims page (uscfc_cmecf@ao.uscourts.gov Case Number:1:08-cv-00700-FMA) and saw the attachments.

The McLemore/OIG report is one of them. That’s already been posted on this site.

Exibits #1 and #2 are the best though. I've posted them here for the entertainment of all.

If ATF is going to file a lawsuit against Dobyns then they better also be filing against Ford and Torres (read the counterclaim response). Is ATF going to say that Ford playing groupie to Hollywood stars, spending ATF money to go to Hollywood parties and Torres promoting his own TV and movie projects, all for personal gain and using their positions and titles to do so somehow falls under an ATF policy other than the one they are suing Dobyns for?

As is evidenced by how they handled McLemore, ATF has a set of rules for their favorites and an entirely different set of rules for the rest of us. They are proving it again with the Ford and Torres situations.

Can someone confirm this as accurate?

First, see the posting How Real Cops Handle Their Business. Now, the word is that Torres is forming an ATF Task Force to investigate the boobytraps set for the cops. Didn’t Torres ignore the threats to Dobyns when the HA recruited the MS-13 to find and torture his daughter?

More, any truth to the rumor that Torres is trying to publish his memoir titled The Hispanic Field General?

I’m not kidding here. I wish I was.

Is this for real? Everyone has known for years that Wilfred L Ford has been using ATF PGA as his own play ground. There has been proof positive that his signature has graced multiple lies to members of Congress. Government standards say "you sign it, you own it". Now we become aware that the agency and the taxpayers have been funding his and SAC Torres chase for fame and $$$$$. This is outrageous government conduct at its best. If the Senate appropriations committee doesnt immediately frezze ATF funding until a full acounting of what is going on in the HQ palyground, they are derelicting their duty to the American people. This is not Ford and Torres personal entertainment network. How many trips has he made in furtherance of his glad handing to Hollywood. I encourage ALL to read the attached document. MR MELSON ARE YOU PAYING ATTENTION? Please dont say "I didnt know" because you either do know or should have known.

This posting is directly related to the discussion topic A Precedent Setting Legal Decision. The attached court document was recently filed in United States Federal Court.

After ATF and DOJ’s attempt to kill the Dobyns lawsuit was denied by the presiding Judge the government immediately filed a countersuit against Dobyns. Attached is Agent Dobyns' answer to the court regarding the allegations the government has made against him.

Read the document. It is lengthy but it is compelling. This is clearly going to be a nasty and public battle as the Department of Justice and ATF come after an agent with their full arsenal. It appears that Agent Dobyns is up to the fight and showing no signs of backing down.

After reading Agent Dobyns' answer it appears to further expose several flaws within ATF.

  • Within ATF the right hand does not know what the left hand is doing. Communication within ATF is most obviously out of whack.
  • ATF executives have no regard for federal whistleblower protections. It is confusing as to how a federal agency can be this ignorant of law.
  • ATF executives are more than willing to act as “True Believers” of everything they are told by agency attorneys. Those attorneys are providing the executives skewed versions of the facts and the executives are signing on for the impending war.
  • ATF executives have no qualms about openly retaliating against agents who file disputes against ATF.
If nothing else is clear, full public exposure of the events, circumstances, ATF’s wrongdoer’s and mismanagement is inevitable. Win or lose I believe that Agent Dobyns is entrenched to make known the facts of his dispute and hold ATF executives publicly accountable.

This won't end quickly. The next 18 to 24 months of this fight should provide the viewers and participants of this website the needed transparency of what has taken place and at a minimum some good entertainment.
